1. Service Overview

PhishNext is a web-based phishing simulation tool designed to conduct phishing simulations on your organization's employees. The Service helps identify vulnerable individuals within an organization and provides training resources to mitigate phishing risk. PhishNext also provides training to candidates who fail simulations by clicking URLs or downloading malicious attachments unknowingly.

PhishNext is a subsidiary of Craw Security and is developed and maintained by Craw Security.

2. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information about yourself and your organization. You are responsible for maintaining confidentiality of your credentials and for all activities under your account.

3. Charges and Payment

PhishNext operates on a pay-per-person model. Charges are based on the number of individuals simulated in each campaign and invoiced accordingly.

• Pricing: Available on our website or as per agreed contract.
• Payment Terms: Payments must be made in advance for the selected subscription/service plan.
• Currency: Payments are made in Indian Rupees (INR), unless otherwise specified.

4. User Responsibilities

• Ensure participant authorization for phishing simulations.
• Use the Service lawfully and in compliance with applicable privacy and cybersecurity laws.
• Do not use the Service for illegal, harmful, or malicious activities.

5. Confidentiality and Data Security

PhishNext handles personal and organizational data in accordance with our Privacy Policy. We implement reasonable security measures to protect data from unauthorized access.

• Data Ownership: You retain ownership of your input data.
• Data Storage: Data is retained as needed operationally or as required by law.

6. Intellectual Property

All content, software, and materials in the Service are owned by or licensed to Craw Security and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

7. User Content

You are solely responsible for any content you upload, input, or generate via the Service. PhishNext may remove content that violates these Terms.

8. Service Availability

We make reasonable efforts to keep the Service available 24/7, but uninterrupted access is not guaranteed. Scheduled maintenance or emergency updates may cause temporary disruptions.

In case of outages, we will notify users promptly. We are not liable for damages caused by downtime.

9. Termination and Suspension

Craw Security may suspend or terminate access if you violate these Terms, fail to pay on time, or for other necessary reasons.

You may cancel by written notice. Payments are non-refundable, and access remains until the end of the current billing cycle.

10. Limitation of Liability

To the maximum extent permitted by law, Craw Security is not liable for indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Craw Security and its affiliates from claims, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Governing Law and Dispute Resolution
